Translation issues: Lawyers for man accused of plotting mass shooting in Milwaukee ask that trial be delayed

MILWAUKEE — Lawyers for the man accused of plotting a mass shooting in downtown Milwaukee have asked that his trial be delayed.

Samy Hamzeh’s trial was set to begin on Jan. 24th but his lawyers want that pushed back due to translation issues.

Hamzeh was indicted on three counts of knowingly receiving and possessing a firearm not registered to him — two machine guns and a silencer, charges to which he’s pleaded not guilty.

He’s accused of planning to kill at least 30 people. According to the criminal complaint, Hamzeh engaged in extensive conversations with two confidential sources, and those conversations, which were in Arabic, were monitored, recorded and translated by the FBI beginning in October 2015. Dylann Roof wants to fire his lawyers because they’re not white

Racist mass murderer Dylann Roof wants to fire his lawyers — calling them “political and biological enemies” who can’t be trusted — because one is Jewish and the other is Indian.

The convicted Charleston church shooter filed a handwritten request with the U.S. 4th Circuit Court of Appeals on Monday from death row to have his appointed attorneys replaced on account of their ethnicity, The State newspaper reports.

“My two currently appointed attorneys, Alexandra Yates and Sapna Mirchandani, are Jewish and Indian, respectively. It is therefore quite literally impossible that they and I could have the same interests relating to my case,” Roof explained in his motion.

Lawyers Of Man Accused Of Plotting A Mass Shooting Said He Was Set Up By The FBI

Sixteen months after the FBI announced it thwarted a planned mass shooting at a Masonic temple in Milwaukee, lawyers for the suspect claim he was pressed and entrapped by FBI agents for months. The claim states that Samy Mohamed Hamzeh, 25, told the FBI a mass shooting would be wrong.

The new court motion asks that Hamzeh, be released on bail pending his trial, which is set for February. Hamzeh’s family also claims he was set up by the FBI, according to the Milwaukee Wisconsin Journal Sentinel.

Federal prosecutors said Hamzeh was planning to kill at least 30 people to “defend Islam” when he was arrested in early 2016. He was charged with two counts of possessing a machine gun and one count of possessing a silencer, weaponry he purchased from undercover FBI agents.

Lawyers for Virginia opposes any halt to execution of Ricky Gray

An effort by spree killer Ricky Javon Gray to stop his scheduled Jan. 18 execution by injection is based on speculation and anecdotal evidence from other states must fail, argues the Virginia Attorney General’s office.

Gray’s lawyers are challenging Virginia’s plan to use drugs that were not created by pharmaceutical manufactures. Citing botched executions elsewhere, they contend the use of the drugs could lead to cruel and unusual punishment and suggested that a firing squad would be more humane than either death by injection or the electric chair.

They have filed a request for a temporary restraining order and preliminary injunction to halt the execution.

Virginia law has allowed inmates to choose between the electric chair and injection since 1995. Injection is the default method for those who will not choose and the state has conducted 80 executions by

Accused mass killer Dylann Roof can hire lawyers back for verdict phase

A federal judge agreed Monday to let a white man accused of fatally shooting nine black parishioners rehire his attorneys until a verdict is reached, but to remain his own lawyer if he is found guilty and the trial moves into a penalty phase.

The decision by U.S. District Judge Richard Gergel ended a week of Roof acting as his own lawyer in his death penalty trial. Roof wrote the judge a handwritten note with his request over the weekend.

It is unclear why Roof is so determined to keep the lawyers out of the penalty part of his case. In their own motion Friday asking Gergel to order Roof to hire them back, they suggested there is something embarrassing Roof is afraid they might use to try to spare his life. They did not elaborate.

Lawyers: Mass shooting suspect too immature for death penalty …

EVERETT — Attorneys for the man charged with the July 30 mass shooting in Mukilteo say evidence suggests he has been living with untreated neurological problems and potential mental illness, and that justice demands more study before prosecutors decide whether to seek his execution.

Preliminary testing also suggests Allen Ivanov, 20, has the brain development of somebody years younger, defense attorney Walter Peale wrote in court papers.

“Age is not the determiner of immaturity; brain development is,” Peale wrote. “Allen Ivanov’s brain development will show he is a ‘juvenile’ to whom the death penalty cannot apply.”

Peale filed the pleadings Thursday in preparation for a Dec. 14 hearing. He wants Snohomish County Superior Court Judge Janice Ellis to extend into January the time prosecutors can be presented information that may help them decide whether to seek the death penalty for Ivanov.
