Translation issues: Lawyers for man accused of plotting mass shooting in Milwaukee ask that trial be delayed

MILWAUKEE — Lawyers for the man accused of plotting a mass shooting in downtown Milwaukee have asked that his trial be delayed.

Samy Hamzeh’s trial was set to begin on Jan. 24th but his lawyers want that pushed back due to translation issues.

Hamzeh was indicted on three counts of knowingly receiving and possessing a firearm not registered to him — two machine guns and a silencer, charges to which he’s pleaded not guilty.

He’s accused of planning to kill at least 30 people. According to the criminal complaint, Hamzeh engaged in extensive conversations with two confidential sources, and those conversations, which were in Arabic, were monitored, recorded and translated by the FBI beginning in October 2015. Judge refuses to release man held in mass shooting plot at Milwaukee Masonic center

A Milwaukee man the FBI says had planned a mass shooting but whose lawyers argue is merely a blowhard “Palestinian Walter Mitty” will remain jailed until his trial, a federal magistrate judge has ruled.

“It comes down to this,” wrote U.S. Magistrate Judge David E. Jones. “It should not take the spiritual guidance of two religious leaders to dissuade a person from committing mass murder.

“A person whose moral compass depends so heavily on the advice of others on such a  fundamental question of human decency presents an unacceptable risk.”

Samy Hamzeh, 25, has been detained since his arrest in January 2016 when he bought two machine guns and a silencer from undercover FBI agents after months of conversations Hamzeh had with a pair of FBI informants.

Man charged in mass shooting plot in Milwaukee seeks release

MILWAUKEE (AP) — Lawyers for a man charged in a mass shooting plot in downtown Milwaukee say their client refused to participate when urged by FBI informants they say harassed him for months.

The Milwaukee Journal Sentinel (http://bit.ly/2tBoKp9 ) reports that lawyers for 25-year-old Samy Mohamed Hamzeh claim entrapment in the case and have asked Hamzeh be released from jail on bail pending his February trial.

The motion comes after the defense reviewed hours of recently translated Arabic conversations the informants recorded.

“There is also no evidence that Hamzeh ever made any plans or was doing anything other than making empty boasts to express his resentment about Israel or to gain attention,” the brief in support of the bond motion said.

Man accused of plotting mass shooting at Milwaukee’s Scottish Rite claims entrapment

Lawyers say the FBI tried to entrap the man accused of planning a mass shooting at the Scottish Rite Masonic Center in downtown Milwaukee, and add that he refused to take part in the shooting.

When the feds announced they had foiled a mass shooting at Milwaukee’s Scottish Rite Masonic Center last year, they said accused plotter, Samy Hamzeh, wanted to kill 30 people “because these 30 will terrify the world.”

Hamzeh denied the allegations in his first court appearance.

Now, in court records, Hamzeh’s lawyers say prosecutors failed to tell the rest of the story — that translations of Hamzeh’s Arabic conversations with two federal informants show Hamzeh ultimately called off the Scottish Rite plot saying, “Get me out of this.”

Man charged in mass shooting plot at Milwaukee Masonic center seeks release

Sixteen months after the FBI announced it had thwarted a planned mass shooting in downtown Milwaukee, lawyers for the man charged in the plot say he adamantly refused to participate when pressed by informants they say had been goading their client for months.

The claim comes in a new court motion that Samy Mohamed  Hamzeh, 25, should be released on bail pending his trial, now set for February.

The motion reveals new details about the defense’s claim of entrapment, gleaned from hours of now-translated Arabic conversations the informants recorded.

His family says Hamzeh, who was born in the U.S. but lived much of his childhood in Jordan before moving to Milwaukee at age 19, was set up by the FBI.
