No new trial for Sheley: Appellate court says judge’s nap doesn’t warrant relitigation

Nicholas Sheley looks around the courtroom during opening arguments May 19, 2014, at the Rock Island County Justice Center. An Illinois appeals court has ruled that the judge falling asleep during one of Sheley’s murder trials doesn’t warrant a retrial, saying Judge Jeffrey O’Connor’s nap was harmless as long as he wasn’t sleeping during crucial evidence or motions.

Court upholds Sheley conviction

GALESBURG — An appellate court upheld the convictions of spree killer Nicholas T. Sheley in his Rock Falls case in an opinion issued late last week.

In a 2-1 decision, the Third District Court of Appeals in Ottawa upheld Sheley’s conviction on four counts of first-degree murder that led to four life sentences. That Whiteside County case involved the June 2008 killings in Rock Falls of Brock Branson, 29; Kilynna Blake, 20, and her son, Dayan, 2; and Kenneth Ulve, 25.

The issue brought up on appeal was that Circuit Judge Jeffrey O’Connor fell asleep while a videotape was played during the 2014 jury trial. That occurred while then-Galesburg Police Officer Bradley Cirmotich testified to security camera footage that showed Sheley in Galesburg on June 28, which is when Sheley murdered Ronald Randall in

Spree killer Nicholas Sheley pleads guilty to killing couple in Missouri

HILLSBORO, Mo. (AP) — A man who killed six people in Illinois before killing two people in Missouri wept and begged the victims’ families for forgiveness Wednesday before he was sentenced to life in prison for the Missouri deaths.

Nicholas Sheley, who initially faced the death penalty, was sentenced to life without the possibility of parole for the 2008 deaths of Jill and Tom Estes. The Arkansas couple were killed while staying at a hotel in Festus, about 30 miles south of St. Louis, after they left a graduation party.

Investigators said Sheley happened upon the couple during a drug- and alcohol-fueled rampage that began in his Illinois hometown.

Sheley dropped to his knees during the sentencing hearing, saying he wished he could take back what he did. He also apologized to law enforcement and others touched by the crimes, The St. Louis Post-Dispatch reported .

“What I did about 10 years ago was wrong

Spree killer Nicholas Sheley pleads guilty to killing couple in Missouri

HILLSBORO, Mo. (AP) – A man who killed six people in Illinois was sentenced to life in prison without the possibility of parole for killing an Arkansas couple at a Missouri hotel.

The St. Louis Post-Dispatch reports Nicholas Sheley was sentenced Wednesday after pleading guilty to killing Jill and Tom Estes of Sherwood, Arkansas. Police say the couple was attacked outside a hotel in Festus after leaving a graduation party in 2008. Investigators say they were random victims.

After a nationwide manhunt, Sheley was arrested in July 2008 in Granite City, Illinois.

He was already serving six life sentences in Illinois for killing six people in that state.

Prosecutors say the string of drug- and alcohol-induced killings began June 26, 2008, in Sheley’s hometown of Sterling, Illinois.

Sheley poised to make a deal

HILLSBORO, Mo. – The long and painful process of bringing Sterling spree killer Nicholas Sheley to justice could come to an end in less than 2 weeks from today.

A plea bargain is in the works for Sheley, who’s facing the death penalty in his final trial, now set for Jan. 8 in Jefferson County.

Sheley, 38, already serving six life sentences for murdering six people in Illinois 9 years ago – between June 23 and 30, 2008 – has an Oct. 4 plea hearing, Jefferson County Court records show.

If the judge agrees to the deal, Sheley also would be sentenced at the hearing. His jury trial will not be canceled until the deal is complete. Jury selection is set for Jan. 4 and 5.

Assistant Prosecuting Attorney Steven Jerrell declined to comment on the deal this morning, as did one of Sheley’s three attorneys, David Kenyon with the Capital Division
